Several representatives of free software associations denounce a partnership signed between Microsoft and the Ministry of Education. They threaten to bring the case to justice.
The representatives of free software associations are launching a warning shot. After criticizing a partnership signed between Microsoft and the Ministry of Education, they say they have formed an internal administrative appeal to the administrative court to denounce this partnership.
The agreement, signed as part of the Digital plan School must allow the use of national education over a period of 18 months several tools from Microsoft. Among the services concerned include Education Office 365, Intune (management of workstations) and Azure Active Directory, needed to identify different users. Microsoft is also committed to providing training to learn the code for students and provide them with a private social network.
EduNathon, a collective that brings together associations Seagull, Ploss-RA and the CNLL (National Council of Free Software) believes that the agreement is likely to harm competition. It should have been called a public market. The group believes that “ the signing of this agreement seems legally very questionable, whether under the competition law, the principles of public procurement or public procurement code provisions . “
The associations therefore propose that the rules of this agreement be reviewed and reclassified as public market. In this alternative, the various publishers of free solutions would be able to offer their tools and compete with Microsoft.
