The European Commission face the dilemma of Adblock software … – Atlantico.fr

Atlantico: How does Adblock system

H16: Adblock basically works on two techniques. The first is to block communications between the ad server and the client (your browser) and the second to hide page elements that meet certain criteria ( for example, part of a class known as advertising). For the first method, this requires to have updated lists of ad networks, server names that send these ads

.

For the second, again, this requires knowledge classes or scripts used for promotional items

Frédéric Mouffle. Adblock is plugin that integrates into the browser ( Chrome, Firefox etc …). It allows detection and identification of advertising inserts or so-called pop-ups that open when the user surfs a website. When the plugin does not block ads from a site, the user can choose to integrate it into its blacklist to prevent advertisements when they are too intrusive or pornographic as the plugin is enabled on the browser. There is also the whitelist principle or the user can choose to allow a site to display its advertisements. There are already quite a list of known sites Adblock automatically integrates this list.

Why suffered the wrath of the European Commission?

H16: with regard to the reaction of the European Commission, we must first remind a little context. Initially, the site alive their traffic minting by presenting advertising, more or less “invasive” on the user’s browser. To display these advertisements, scripts and cookies (small pieces of text placed on the customer’s hard drive allowing the server to maintain data of a browsing session to another) are deposited in the user. In this context, European authorities have imposed (by the ePrivacy Directive 2002/58) that this is done with the full consent of the latter. This resulted in the appearance of messages with explicit validation the user, explaining that cookies are used; these messages and help inform this process

Meanwhile, the average Internet user, probably tired of a growing number of invasive pop , interrupts his reading by videos or images arising from everywhere, quickly with blocking software, including Adblock, which allow him to ‘clean’ these messages appearing on pages where it sails. Obviously, such blocking is felt directly at advertising agencies who in turn remunerate less advertisers websites . The French press, in particular, depends (in addition to State subsidies) advertising to a large extent, these blockers and therefore undermine their revenue . This explains that recently the French newspapers (including Le Figaro, Behold, The Team, The World , …) grouped in GESTURE have plastered awareness messages on their sites, prompting the user to disable their ad blockers, and blocking access to items such as Adblocks are active.

This is where things get on the technical legally, since the point of view of a specialist consultant “privacy” – Alexander Hanff – soon followed by the European Commission itself, the fact of triggering these educational messages requires treatment and side data collection the surfer, collection and treatment that have not been endorsed by the latter under the Directive mentioned above.

in other words, in the first analysis, and according to Article 5 ( 3) of the ePrivacy Directive 2002/58, the user must be able to oppose the outbreak of the anti-lock scripts (or over-blocking) while previously benefiting from information “ clear and complete” . The Commission also cites paragraph 65 of Directive 2009/136, which clearly explains that these “software that records the actions of clandestinely user or subverts the operation of the terminal equipment for the benefit of a third party (software spyware or spyware) poses a serious threat to user privacy “; ie, that kind of unwanted user scripts do not conform to these two points of law

Frédéric Mouffle. First of all, I would say that all scenarios are possible, but I do think the software has an interest in hosting the virus in its plugins. There is no real evidence to support this argument. It begs the question of the economic model Adblock because we can not exclude the fact that it acts as the other sites, that is to say by collecting data and reselling them, if proven. There is not much information on this subject but it is possible that the collection and resale of small amounts of data are, with donations from users, their only business model given that it is’ free software. It seems, however, that some websites have paid to be on the white list of Adblok
